Lifetime disqualification is against Islam, says CJP Isa.

During a Supreme Court hearing in Islamabad, Chief Justice of Pakistan (CJP) Qazi Faez Isa made noteworthy statements regarding the lifetime disqualification of lawmakers under Article 62(1)(F) of the Constitution. CJP Isa emphasized that imposing a lifelong ban on individuals from parliament is inconsistent with Islamic principles. The Supreme Court had taken up the case due to discrepancies in the Election Act, 2017, concerning the duration of disqualification. The case was prompted by a petition filed by former PML-N provincial lawmaker Sardar Meer Badshah Khan Qaisrani, who challenged his lifetime disqualification in 2007 on the grounds of possessing a fake degree.

CJP Isa stressed the importance of expeditiously resolving the constitutional issue to avoid confusion among returning officers responsible for handling nomination papers for the upcoming elections.

In today’s hearing, which was presided over by a seven-member bench led by CJP Isa, the aim was to seek clarity on the disqualification period for lawmakers, specifically whether it should be a five-year term as per the Election Act 2017 or a lifetime ban under Article 62(1)(F).

CJP Isa referred to Islamic principles, highlighting the respect for human status as depicted in the Holy Quran. He emphasized that the concept of lifetime disqualification contradicts the possibility of repentance, which is a fundamental aspect of Islam.

Discussions took place regarding the need for a constitutional amendment to address lifetime disqualification, as well as cautionary remarks against creating obstacles in the upcoming elections. A lawyer representing the petitioners faced rigorous questioning from the bench, with CJP Isa expressing concerns about advocating for lifetime disqualification and suggesting that it aligns with dictatorial tendencies.

The hearing was adjourned, with the intention to resume deliberations the following day. The outcome of this case will have significant implications for the eligibility of various politicians, including figures like Nawaz Sharif and Jahangir Tareen, in the upcoming polls.
