Appeal Against Military Court

The Sindh government denies rumors of filing an appeal against the Supreme Court’s military court verdict.

A representative of the Sindh government dismissed the claims of initiating an appeal as unfounded.

On November 16, there were reports suggesting that the Sindh government had lodged an appeal with the Supreme Court challenging the suspension of civilian trials in military courts.

Additionally, the provincial government urged the apex court to overturn the decision halting the trials and requested a suspension of the Supreme Court’s decision until a resolution on the appeal was reached.

The application asserted that individuals accused of attacking military installations should face trial in military courts, arguing that the Supreme Court had not adequately reviewed the legal and factual aspects of the case.

The Sindh government also sought the reinstatement of revoked sections of the Army Act and the Official Secrets Act. It contended that the suspects themselves had requested to be tried in military courts.

Moreover, the appeal claimed that challenges against military court trials were not admissible, emphasizing that the court’s judgment failed to specify the fundamental rights being affected.

According to the appeal, there exists a right to appeal to the army chief and high courts against the decisions of military courts. It further suggested that the court could have directed the petitioners to address the relevant forum.
